State Senator Terry Burton says he was found innocent of a second DUI after he appeared in Scott County Justice Court on Thursday.
Burton says the Scott County judge ruled cough syrup and breath spray must have caused a "false positive" reading on the breathalyzer test he took after he wrecked.
"I had a coughing spell after all the powder and dust blew from the airbags deploying. I drank some Nyquil since I didn't have any water in the car and then used breath spray because my mouth felt like cotton," Burton said.
Burton was arrested and charged with DUI after his SUV ran off I-20 and hit a sign in Scott County on May 14. The highway patrol's arrest report shows the lawmaker, from Newton, registered a .10 blood alcohol level that night.
